Men Helpline Submits Representation to Ministry of Law & Justice on Gender-Neutral AI Governance

Men Helpline has formally submitted a representation to the Ministry of Law & Justice regarding the need for gender-neutral and audit-based AI governance frameworks.

Respected Sir/Madam,

I write in my capacity as Founder of Men Helpline, a civil society organization working on issues relating to gender equity, family welfare, and constitutional balance in public policy.

Recent public discourse has increasingly framed Artificial Intelligence (AI) systems as being “designed by men and for men,” thereby implying structural gender-origin bias. Such narratives risk influencing future regulatory discussions in a manner that shifts AI governance from a technical and audit-based framework to an identity-driven one.

Artificial Intelligence systems are shaped by training datasets, algorithmic calibration, institutional policy parameters, and regulatory oversight — not by biological identity. Governance reform, therefore, must remain evidence-based and constitutionally aligned.

At the same time, it would be equally concerning if AI systems were to exhibit asymmetrical enforcement patterns that disproportionately affect men or underrepresent male vulnerabilities in harm-recognition frameworks. Emerging observations across digital ecosystems suggest the possibility of uneven moderation standards and selective recognition of gendered harms. Such outcomes, if present, would contradict the constitutional mandate of equality under Articles 14 and 21.

If bias exists — whether against women or men — it must be identified through measurable and transparent mechanisms, including:

  • Independent dataset audits
  • Publication of comparative false-positive and false-negative rates
  • Transparent moderation benchmarks
  • Symmetrical enforcement standards
  • Gender-neutral regulatory language

AI governance should not be shaped by narrative attribution, but by empirical evaluation and technical verification.

As India advances toward broader AI adoption and regulatory development, it is essential that policy frameworks ensure universal safeguards without introducing identity-based asymmetry. A gender-neutral, audit-based governance model will strengthen public trust and uphold constitutional principles of equality before law.

We respectfully submit that:

  • AI regulation should remain gender-neutral in language and enforcement.
  • Transparency and accountability mechanisms should be mandatory.
  • Policy formulation should be based on empirical evidence and technical audits.
  • Protection standards should apply equally to all genders.

In an era where AI adoption is accelerating across sectors, balanced and inclusive governance will be critical to maintaining public trust and institutional fairness.

We respectfully request that the Ministry consider ensuring that any future AI-related legislative or regulatory initiatives remain neutral, data-driven, and inclusive of all citizens.
